TERMS OF SALE

 

If you are a UMGF member, then UMGF rules apply to the extent they are inconsistent with these Terms of Sale.  Otherwise, the following Terms of Sale apply to all sales, and Buyer hereby acknowledges and accepts these Terms of Sale:

Listed Prices

1.   All list prices are negotiable.

2.  Prices are subject to change or correction at any time.
3.  Unless otherwise noted, asking prices do NOT include shipping / insurance.  
 

Payment

1.  Payment must be received before the guitar is shipped to you.

3.  Buyer is responsible for any payment / transaction fees or wire transfer fees.

 

Shipping & Insurance
 

1.  For both parties' protection, shipping insurance is required - at Buyer's expense.

2.  Shipping will be via UPS or FedEx, at my discretion.  I will ship via ground or air shipping, according to Buyer's preference. 

3.  International shipping available on a case-by-case basis, in my discretion, and at buyer's sole cost.

4.  Insurance is for the Buyer's benefit and therefore any insurance claim must be made by Buyer.  I assume no responsibility for insurance claims that are denied due to inadequate or improper documentation or any other reason outside of my direct control.

Trades
 

1.  Reasonable trade offers are welcome.

2.  However, the Buyer pays shipping on all trades.  This includes the cost of shipping your trade guitar to me and the cost of shipping your guitar to you.

Return Policy
 

1.  Buyer has 72 hours from delivery of the guitar to inspect and approve.

2.  Guitar may be returned for any reason by giving me written notice (via email or text message) within the 72 hour return window.

3.  Upon receipt of the guitar, and assuming it arrives in the same condition it was in when it left here, I will issue a full refund (less all applicable shipping charges and transaction fees, if any).  

4.  Before returning a guitar, you should carefully photograph its condition immediately before boxing it up and send me photos to document its condition.  Buyer is responsible for insuring the return shipment and is responsible for any damage while in transit.

 

Resolution of Disputes
 

1.  Any dispute arising out of or relating to a guitar purchased on this site shall be resolved in Knox County, Tennessee, which Buyer agrees shall be the sole and exclusive venue for resolution of disputes between Buyer and Seller.  

2.  If either party commences litigation, the prevailing party will be entitled to recover reasonable attorneys' fees and discretionary costs incurred in connection with such litigation.

Updates
 

1.  These Terms of Sale may be updated from time to time, without notice.  However, the Terms of Sale in effect as of the date of payment from Buyer shall govern.
